In order to protect the rights and interests of consumers nationwide, the Indian government introduced the Consumer Protection Act (CPA) of 2019. It supersedes the previous Consumer Protection Act of 1986 and sets an emphasis on encouraging fair trade practises while protecting consumers from unfair trade practises and business exploitation.


What is a Consumer Complaint?

A consumer complaint is a formal expression of the customer's dissatisfaction with the product or service  received. Complaints may relate to issues such as low quality, high prices, misleading advertising, broken promises, and poor customer service. These complaints can be made through a variety of channels, including corporate customer service lines, email, social media, and government agencies responsible for consumer protection. Consumer complaints can affect a company's reputation and customer loyalty, so it is important for businesses to effectively address and resolve consumer complaints. The Consumer Protection Act (CPA) was enacted in 1986 to  better protect consumer interests  and establish consumer councils and other bodies to resolve consumer disputes. The law has since been amended several times, with the last amendment passed in 2019. According to the law, consumer complaints can be lodged in the competent consumer court or consumer court, depending on the value of the goods or services in question. Complaints may be sent to manufacturers, distributors, retailers or service providers. Complaints should include details such as the complainant's name and address, the facts of the complaint, and the remedy sought. Any consumer court or tribunal has the power to order damages, refund or replacement of  goods or services, and to award punitive damages and costs.  The CPA also provides for the establishment of the Central Consumer Protection Agency (CCPA), which has the power to investigate and prosecute cases of unfair trade practices, false or misleading advertising, and violations of consumer rights. It will be. The CCPA has the power to impose fines, order product recalls, and even bring class action lawsuits on behalf of consumers.



Fines: The ASCI can impose a fine of up to Rs. 10 lakhs on the advertiser for a first-time offense. Repeat offenders may be fined up to Rs. 50 lakhs.
Imprisonment: The Consumer Protection Act, 2019, provides for imprisonment for up to two years and a fine of up to Rs. 10 lakhs for a first-time offense. Repeat offenders may be imprisoned for up to five years and fined up to Rs. 50 lakhs.
Product recall: The ASCI can order the advertiser to withdraw the misleading advertisement and recall the product from the market.
Loss of license: The ASCI can revoke the advertiser's license to advertise if the advertiser is found guilty of repeatedly violating the ASCI's guidelines



Identify the appropriate consumer forum:

 The first step is to determine which consumer forum is the appropriate one to file your complaint. This will depend on the value of the goods or services involved and your location. The three levels of consumer forums are: District Consumer Disputes Redressal Forum (for claims up to Rs. 20 lakh), State Consumer Disputes Redressal Commission (for claims between Rs. 20 lakh and Rs. 1 crore) and National Consumer Disputes Redressal Commission (for claims above Rs. 1 crore).


Gather evidence and documents:

  1.  You will need to gather all relevant documents and evidence to support your complaint, such as receipts, invoices, contracts, warranties, photographs, and any communication with the seller or service provider. This will help you to present a strong case before the consumer forum.


Draft the complaint:

The next step is to draft the complaint, which should include the details of the dispute, the relief sought, and the evidence and documents supporting your claim. The complaint should be written in a clear and concise manner and must be signed by the complainant.


Submit the complaint:

You can submit the complaint along with the necessary documents and evidence to the appropriate consumer forum either in person or by registered post. You will also need to pay the prescribed fee, which varies depending on the value of the claim.


Attend the hearing:

After the complaint is filed, the consumer forum will issue notice to the opposite party and schedule a hearing. You will need to attend the hearing and present your case before the forum


Await the verdict:

The consumer forum will then pass a verdict based on the evidence and arguments presented by both parties. If the verdict is in your favour, the opposite party will be directed to provide the relief sought in your complaint.


  1. In order for the case to be covered by the Consumer Protection Act, it cannot be covered by any civil, criminal, or labour laws.

  2. The complaint should include a refund and claim amount in the prayer section

  3. Customers who only ask for compensation, possessions, returns, or exchanges of goods are not covered by Edakhil's online consumer complaints policy.

  4. A claim, refund, or consideration that exceeds Rupees 50 lakhs cannot be submitted online to the district consumer forum.
